Resumen

Esta investigación tiene como objetivo analizar el derecho al descanso y al disfrute del tiempo libre en Venezuela. En la sociedad, históricamente, el disfrute del tiempo libre ha tenido diferentes interpretaciones y ha sido protegido por instrumentos legales internacionales. Los conceptos de ocio y tiempo libre están vinculados, sin embargo, los doctrinarios los han delimitado. Las percepciones que los trabajadores tienen del ocio varían, de ahí la necesidad de identificarlas, para diferenciar, entre otros, el ocio negativo, sinónimo de no hacer nada, del ocio afirmativo, que permite el desarrollo del ser humano y lo hace “ser”. Para lograr el objetivo propuesto, se realizó una investigación documental y de nivel descriptivo, desde la perspectiva de la teoría del ocio humanista. Se concluye que es necesario capacitar a los trabajadores sobre cómo organizar mejor su tiempo y que aprendan a aprovechar el tiempo libre, valorar e identificar su importancia para tener una mejor calidad de vida y salud. Los actores sociales deben considerar las diferencias en el uso del tiempo libre entre mujeres y hombres y las transformaciones en el mundo del trabajo, para diseñar políticas laborales en temas de tiempo de trabajo con justicia social. La normativa venezolana garantiza el derecho al descanso y al tiempo libre, sin embargo, es necesario contar con un contexto económico y social que brinde condiciones que contribuyan a la viabilidad de la legislación vigente.

Abstract

This research aims to analyze the right to the rest and to the enjoy leisure time in Venezuela. In society, historically, the enjoyment of free time has had different interpretations and has been protected by international legal instruments. The concepts of leisure and free time are linked however the doctrinaires have delimited them. The perceptions that workers have of leisure vary, hence the need to identify them, in order to differentiate, among others, negative leisure, synonymous of doing nothing, of affirmative leisure, which allows the development of the human being and It´s does “be.” To achieve the proposed objective, a documentary and the descriptive level research was carried out, from the perspective of humanistic leisure theory. It is concluded that there is a need to train the workers on how to better organize their time and that the learn to take advantage of free time, value and identify its importance to have a better quality of life and health. The social actors must consider the differences in the use of free time between women and men and the transformationsin the world of work, to design labor policies in themes on working time with social justice. Venezuelan regulations guarantee the right to rest and free time, however, it is necessary to have an economic and social context that provides conditions that contribute to the viability of existing legislation.
